1. Introduction

Align ("Align", "we", "our", or "us") is committed to protecting the privacy and security of information that we collect or receive in connection with the Align application, website, subscription services, and related support services.

This Privacy Policy explains what information Align may collect, receive, use, store, or disclose when you register for Align, purchase or activate a subscription/license, use the Align website or locally installed application, contact us for support, or use related online services.

Align is primarily a locally installed application. Business operational data, including orders, billing records, menu data, reports, and other operational records, is stored locally on the device or computer on which Align is installed.

Align does not routinely access, host, or store the Business's local operational database on Align's servers. Access to the local operational data is controlled by the Business and its authorized users.

Throughout this Privacy Policy, the term "Business" refers to any restaurant, café, coffee shop, cloud kitchen, bakery, food court, quick service restaurant (QSR), dessert shop, juice bar, catering business, or other food service establishment using the Align application.

By creating an account, purchasing or activating a subscription/license, or otherwise using Align, you acknowledge that you have read, understood, and agreed to this Privacy Policy.

This Privacy Policy applies to Business owners, managers, employees, staff members, and other authorized users who access or use Align.

2. Information We Collect

Align collects or receives only the information reasonably necessary to provide the application, manage subscriptions and licenses, process payments, provide support, maintain security, and operate related online services.

2.1 Business Account Information

When a Business registers for Align or uses an online account or subscription service, we may collect information such as the Business name, owner's name, mobile number, email address, business address, city, state, GST number, FSSAI number, logo, and other registration details provided during account creation.

2.2 Staff Information

Staff information entered into the locally installed Align application, including names, mobile numbers, usernames, roles, and login-related information, is stored in the local Align database. Align does not routinely collect or store this operational staff information on its servers.

2.3 Operational Information

Operational information created while using Align, including dining areas, tables, menu categories, menu items, quick items, customer orders, kitchen tickets, billing records, reports, and other operational data, is stored locally in the Align database on the Business's device or computer.

Align does not routinely collect, upload, or centrally store this operational database. If the Business voluntarily provides data, screenshots, exported records, or database files to Align for technical support, that information may be received and used only for the relevant support purpose.

2.4 Payment Information

Subscription payments are processed through authorized third-party payment providers. We may receive payment-related information such as payment status, transaction reference numbers, invoice details, subscription details, and billing history. Align does not store complete payment card or banking information.

2.5 Device and Technical Information

Depending on the feature being used, Align may receive limited technical information such as application version, operating system information, device type, IP address, log information, or diagnostic information where necessary for subscription activation, security, troubleshooting, or support.

2.6 Notification Information

Where notification services are enabled, Align may process notification-related information such as device or messaging tokens required to deliver operational notifications to authorized users. Such information is used only for the relevant notification functionality.

2.7 Support Communications

If you contact us for technical support, feedback, or enquiries, we may collect the information you voluntarily provide, including your name, contact details, messages, attachments, screenshots, exported records, or other information necessary to respond to your request.

3. How We Use Your Information

We use information that we collect or receive only for legitimate purposes necessary to provide, maintain, secure, support, and improve Align and its related services.

Your information may be used for the following purposes:

Business operational data stored locally on the Business's device is not routinely processed by Align's online systems. The Business remains responsible for the use, accuracy, and management of such local operational data.

We do not sell personal information or Business data to third parties for marketing or advertising purposes.

4. Sharing of Information

Align does not sell, rent, or trade personal information or Business data to third parties for marketing or advertising purposes.

We may share limited information only where necessary to provide a requested service, operate related online functionality, protect our rights or security, or comply with applicable law.

Except for the circumstances described above, we will not share personal information held by Align with third parties without your consent unless required or permitted by applicable law.

5. Payment Information

Subscription payments for the Align platform are processed by authorized third-party payment service providers. Align does not collect or store your complete debit card, credit card, net banking, UPI PIN, CVV, or other sensitive payment credentials.

We may receive and store limited payment-related information, including payment status, transaction reference numbers, subscription details, invoice information, billing history, and other information necessary to manage your subscription and maintain financial records.

All payment transactions are subject to the privacy policies and terms of the respective payment service providers. We encourage you to review their policies before completing any payment.

Align is not responsible for the privacy, security, or data handling practices of third-party payment providers.

6. Data Security

Align implements reasonable administrative, technical, and organizational security measures designed to protect information that Align collects or receives against unauthorized access, disclosure, alteration, misuse, or destruction.

Business operational data is stored locally on the Business's device or computer. The Business is responsible for protecting the device, local database, application access, passwords, and other local security controls against unauthorized access.

Align does not routinely access the Business's local operational database. Where a Business voluntarily provides local data or diagnostic information for technical support, Align will use reasonable measures to protect that information while it is in Align's possession.

No method of transmitting data over the internet or storing electronic information is completely secure. Accordingly, Align cannot guarantee absolute security of information transmitted to or provided to Align.

Businesses are responsible for maintaining the confidentiality of their credentials, limiting access to authorized users, protecting their local device and database, and promptly notifying Align if they believe an Align account, license, or related online service has been compromised.

Businesses are also responsible for maintaining independent backups of their locally stored Align database.

7. Data Retention

Align retains information that it actually collects or receives only for as long as reasonably necessary to provide the relevant service, manage subscriptions and licenses, provide support, comply with legal obligations, resolve disputes, enforce agreements, prevent fraud, and protect legitimate business interests.

The Business's operational database is stored locally on the device or computer on which Align is installed. Align does not routinely retain the Business's local operational database on its servers.

Subscription expiry or cancellation does not cause Align to remotely delete the Business's locally stored database. The local data remains under the control of the Business, subject to the operation of the local application and applicable license restrictions.

The Business is solely responsible for taking and maintaining backups of its local Align database. Align does not automatically create or maintain backups of the local database unless a separate backup service is expressly offered, enabled, and agreed upon.

Information such as billing records, payment records, subscription/license records, support communications, or other information that Align actually holds may be retained for a longer period where necessary to comply with legal, tax, accounting, regulatory, security, or dispute-resolution requirements.

Align cannot guarantee recovery of locally stored data that is lost, deleted, corrupted, or made inaccessible because of hardware failure, operating system failure, accidental deletion, malware, physical damage, unauthorized local access, device replacement, or failure to maintain backups.

8. Cookies & Similar Technologies

The Align website and any web-based services may use cookies and similar technologies to provide, maintain, and improve functionality, security, authentication, and performance.

These technologies may be used to maintain secure web sessions, remember preferences, support authentication, improve user experience, and help protect against unauthorized access.

The locally installed Align application may also use local storage, session storage, or other local application storage mechanisms required for its operation. Such local storage is part of the local application environment and is not, by itself, an indication that the Business's operational database is stored in the cloud.

Most web browsers allow you to control or disable cookies through their settings. However, disabling cookies or similar technologies may affect the availability or functionality of certain website or web-based features.

9. Third-Party Services

Align may use trusted third-party service providers for specific online functions required to provide or support the service. These providers may process limited information only as necessary to perform their respective functions.

Third-party services used by Align may include, but are not limited to:

Each third-party service provider operates under its own privacy policy, terms, and data handling practices. We encourage you to review their respective policies before using services that involve those providers.

Align is not responsible for the privacy practices, security measures, availability, or content of third-party services that are outside our control.

10. Your Rights

Subject to applicable law, you may have certain rights regarding personal information that Align actually collects or processes.

Depending on your relationship with Align and applicable legal requirements, you may have the right to:

Business owners and authorized users remain responsible for managing and protecting information stored in the local Align application. Requests relating to locally stored Business data may require the Business owner or authorized user to manage, correct, export, or delete that information directly within the local application, subject to the application's functionality.

If the Business voluntarily provides local data to Align for support, applicable requests concerning that information may be handled based on the nature of the information provided and applicable law.

We may decline or limit certain requests where we are required or permitted to retain information under applicable law, to enforce our legal rights, prevent fraud, protect security, or fulfill contractual obligations.

To exercise applicable privacy rights regarding information held by Align, you may contact us using the contact details provided in this Privacy Policy.

11. Children's Privacy

Align is intended solely for use by Businesses and their authorized users. The platform is not directed to, and is not intended for, individuals under the age of 18.

We do not knowingly collect personal information from children. If we become aware that personal information of a child has been collected without appropriate authorization, we will take reasonable steps to delete such information as required by applicable law.

If you believe that a child has provided personal information through the Align platform, please contact us so that appropriate action can be taken.

12. Changes to this Privacy Policy

Align may update or modify this Privacy Policy from time to time to reflect changes in our services, legal requirements, business practices, or operational processes.

When material changes are made, we will update the "Last Updated" date at the beginning of this Privacy Policy. Continued use of the Align platform after such changes become effective constitutes your acceptance of the revised Privacy Policy.

We encourage Businesses and authorized users to review this Privacy Policy periodically to stay informed about how we collect, use, and protect information.
